Michael J. Guyerson is Certified by the American Board of Certification in Commercial Debtor Bankruptcy and is also a Certified Financial Planner (CFP). A 1981 graduate of the University of Colorado School of Law, Mike’s practice emphasizes insolvency and commercial loan restructuring, the overall representation of debtors, creditors’ committees, trustees and creditors in bankruptcy matters, commercial and bankruptcy litigation and agricultural law.

Adversary Matters
Mike was co-trial counsel for the Plaintiff in the case of In Re S & D Foods, Inc. 144 B.R. 121, 158 (Bankr. D. Colo. 1992), notable because of the $11.4-million-dollar fraud and breach of partnership agreement verdict returned by the Bankruptcy Court in that adversary proceeding, one of the largest ever returned by a Colorado Bankruptcy Court.

Appellate Matters
Lead trial and appellate counsel for published Tenth Circuit Court of Appeals Opinion properly enforcing 28 U.S.C. §1473(d) and ruling that the proper venue for Trustee to prosecute turnover action is home Bankruptcy Court, In Re B& L Oil Company, 834 F.2d 156 (10th Cir. 1987)

Debtor Representation
Rancher Energy Corp. (Case No. 09-32943 Bankr.D.CO), plan confirmed resulting in a full re-payment to all unsecured creditors and a return to equity of over 1.5 million in cash; Corsa Investments LLC d/b/a Sleep Inn at DIA, (Case No. 10-27589 Bankr.D.CO.), plan confirmed with a minimal disruption of an 119 room hotel operation; Chemrite Industries, LLC ( Case No. 05-36040 Bankr.EasternD.WI.), plan confirmed with an asset sale for an operating mid-west chemical supply company; In Re Walck, Case No. 11-37706 Bankr.D.CO.), plan confirmed for original homesteaded ranch property and gas mineral rights in western Colorado; and White Buffalo Trading Company & Diamond K, Inc. (Jointly Administered Debtor Case No 08-29314 Bankr.D.CO. ) plan confirmed in less than 11 months for a ranch and separate real estate development property in southwestern Colorado.
